Its primary purpose is to ensure that your customers, not you, are held responsible for adhering to the complex and strict policies of Regional Internet Registries (RIRs) like RIPE and ARIN. Section 2.1 is the cornerstone, legally binding the customer to RIR policies. Section 3.1 is critical for clarifying that customers are only licensees, not owners, of the IP addresses, which prevents ownership disputes upon service termination. Finally, Section 4.3 provides you with the unequivocal right to reclaim IP addresses in cases of misuse or non-payment, a necessary tool for managing a finite and valuable resource.

This IP Address Services (LIR) Addendum (the "Addendum") applies to all customers who apply for or lease IP address resources from NCSE NETWORK LTD ("NCSE"). As a member (Local Internet Registry, or LIR) of a Regional Internet Registry (RIR), such as RIPE NCC or ARIN, NCSE provides IP address services in accordance with RIR policies.
This Addendum supplements the NCSE Master Terms of Service, and together they form the complete service agreement. In the event of any conflict between this Addendum and the Master Terms of Service, the terms of this Addendum shall prevail.
The IP Address Service (the "Service") consists of NCSE assisting the Customer in applying for IPv4/IPv6 addresses from the relevant RIR, or assigning IP address blocks to the Customer from NCSE's own pool of IP addresses.
2.1. Adherence to RIR Policies: The Customer agrees and warrants that their use of any and all IP addresses provided by or applied for through NCSE will strictly comply with all current policies, guidelines, and regulations of the corresponding RIR (RIPE NCC, ARIN, etc.). The Customer is responsible for staying informed of these policies.
2.2. Provision of Truthful Information: When applying for IP addresses, the Customer must provide truthful, accurate, and complete justification and network deployment plans. Any false information may lead to the rejection of the application or the reclamation of allocated addresses.
2.3. WHOIS Information Maintenance: The Customer is obligated to provide and maintain accurate WHOIS contact information. Inaccurate WHOIS data is a violation of RIR policy and may result in the reclamation of IP addresses.
3.1. Right of Use, Not Ownership: The Customer acknowledges that they are granted a "right to use" the IP addresses, not ownership thereof. Ultimate title to all IP addresses remains with the respective RIR.
3.2. Non-Transferability: The Customer may not transfer, sublease, or sell any assigned IP addresses to any third party without the express written consent of NCSE and the corresponding RIR.
4.1. Prohibition of Abuse: The use of IP addresses for any illegal or abusive activities is strictly prohibited. This includes, but is not limited to, spamming, phishing, DDoS attacks, or any violation of the Acceptable Use Policy (AUP).
4.2. IP Reputation: The Customer is responsible for maintaining a good reputation for the IP addresses they use. If actions or inactions by the Customer cause an IP address to be placed on any major blocklist, the Customer must take immediate corrective action.
4.3. Right of Reclamation: NCSE has the right to immediately reclaim any assigned IP addresses without prior notice if the Customer breaches this Addendum or RIR policies, or upon termination of service. Once reclaimed, all route announcements for the IP addresses will be withdrawn.
The Service may include one-time application fees and recurring annual maintenance fees. All fees are prepaid and non-refundable. Application processing fees are non-refundable even if the Customer's IP application is ultimately not approved by the RIR.
