This Colocation Services Addendum (the "Addendum") applies to all customers who order Colocation services from NCSE NETWORK LTD ("NCSE"). This Addendum supplements the NCSE Master Terms of Service, and together they form the complete service agreement. In the event of any conflict between this Addendum and the Master Terms of Service, the terms of this Addendum shall prevail.
The Colocation Service (the "Service") consists of NCSE providing cabinet space, power, cooling, and network connectivity within its partner data center facilities for the customer to install and operate their own servers and network equipment (the "Customer Equipment").
2.1. Equipment Specifications: The Customer shall ensure that its Customer Equipment conforms to standard rack-mountable specifications and is in good working condition. NCSE reserves the right to refuse the installation of any equipment that may pose a hazard to the data center environment or does not meet safety standards.
2.2. Installation Responsibility: The Customer is solely responsible for the transportation, installation, configuration, and maintenance of the Customer Equipment. If the Customer requires installation assistance from NCSE ("Remote Hands"), additional fees may apply.
2.3. Title to Equipment: The Customer is, and shall at all times remain, the sole legal owner of the Customer Equipment. NCSE has no ownership interest in or lien on the Customer Equipment, except as a remedy for any outstanding payments.
3.1. Authorized Access: Only personnel who have been pre-authorized in writing by the Customer and successfully verified by NCSE will be granted access to the data center facility. The Customer must provide a complete list and contact information for all authorized personnel.
3.2. Scheduled Access: All facility access must be requested through our client portal at least [24]
hours in advance of the desired time. Requests for emergency access will be handled on a case-by-case basis.
3.3. Compliance with On-site Rules: All individuals entering the facility must comply with all data center security protocols, codes of conduct, and on-site instructions from NCSE personnel. Any violation may result in the immediate revocation of access privileges.
4.1. Power Availability: NCSE commits to providing continuous and uninterrupted power. In the event of a power outage, compensation will be provided according to the 99.5% Uptime SLA defined in the Master Terms of Service.
4.2. Environmental Control: NCSE will ensure that the ambient temperature and humidity within the data center are maintained within industry-standard operating ranges for proper equipment function. The availability of this service is also covered by the 99.5% Uptime SLA.
4.3. SLA Exclusions: This SLA does not cover power interruptions caused by Customer Equipment failure (e.g., a short-circuited power supply), customer error, or exceeding the amperage limit of the ordered power circuit.
IT IS THE CUSTOMER'S SOLE RESPONSIBILITY TO PROCURE AND MAINTAIN ADEQUATE PROPERTY INSURANCE FOR ALL CUSTOMER EQUIPMENT housed within the data center. The coverage must include, but is not limited to, protection against fire, flood, theft, and any form of physical damage. Under no circumstances will NCSE be liable for any physical loss of or damage to the Customer Equipment.
NCSE can provide "Remote Hands" services upon customer request, such as rebooting equipment, replacing cables, or checking equipment status indicators. The scope and fees for such services will be agreed upon separately.
