Acceptable Use Policy (AUP)

This Acceptable Use Policy (the "AUP") governs the use of all services provided by NCSE NETWORK LTD ("NCSE") and is designed to ensure the stability, security, and legality of our network environment. This AUP is an integral part of the NCSE Master Terms of Service and is binding on all customers and their end-users.

A VIOLATION OF THIS AUP CONSTITUTES A MATERIAL BREACH OF THE TERMS OF SERVICE AND MAY RESULT IN THE IMMEDIATE SUSPENSION OR TERMINATION OF YOUR SERVICES WITHOUT A REFUND.

1. Illegal or Harmful Activities

You may not use NCSE's services for any illegal, infringing, or harmful purposes. Such activities include, but are not limited to:

• Violation of Law: Engaging in any activity that violates any applicable local, national, or international law or regulation.
• Fraudulent Activities: Conducting any form of fraud, including phishing, Ponzi schemes, or any plan intended to deceive others.
• Infringement of Intellectual Property: Hosting, distributing, or linking to content that infringes on the copyright, trademark, patent, or trade secrets of others (e.g., unauthorized software, audio/video files).
• Defamation or Harassment: Distributing content that is defamatory, harassing, abusive, or threatening.

2. Network Abuse and Security

You must respect the integrity of the network and may not compromise the security or availability of NCSE's or any other network. Prohibited actions include, but are not limited to:

• Malicious Attacks: Initiating or participating in any form of Denial of Service (DoS/DDoS) attacks, or distributing malware, viruses, or worms.
• Unauthorized Access: Attempting to scan, probe, or penetrate the vulnerabilities of any system or network not your own, or breaching its security or authentication measures.
• Network Disruption: Any activity intended to disrupt the normal functioning of other users, hosts, or networks, such as network flooding or mail bombing.
• Forging Information: Forging TCP/IP packet headers, email headers, or any part of a message's source-identifying information.

3. Email and Messaging Abuse (Spam)

NCSE has a zero-tolerance policy for spam. You may not use our services to send, or facilitate the sending of, Unsolicited Commercial Email (UCE / Spam). Prohibited actions include:

• Sending any email that violates the CAN-SPAM Act or other applicable anti-spam laws.
• Using mailing lists that have been obtained through improper means.
• Using our services to host websites or services that are advertised in spam messages.

4. Resource Usage

You agree not to consume excessive system resources in a way that may negatively impact server performance or network stability. This clause is particularly applicable to shared resource environments like VPS. Actions that may constitute excessive use include:

• Running processes that cause a sustained high CPU utilization.
• Generating extremely high I/O (disk read/write) load.
• Any other activity that could degrade the quality of service for other customers on the same host.

5. Enforcement of the AUP

We reserve the right to investigate any potential violation of this AUP. During an investigation, we may suspend your services to prevent potential further harm.

If we determine that you have violated this AUP, we may, based on the severity of the violation, take one or more of the following actions:

• Issue a written warning.
• Temporarily suspend your account or specific services.
• Permanently terminate your account and all services.
• Charge you administrative fees for handling the violation.
• Report illegal activities to law enforcement authorities.

We will be the sole arbiter in determining whether a violation has occurred.
